Zemekt Nigeria Limited ("we" or "our" or "us") is the owner and operator of ZemCash (the “App”), both the web and app versions. We highly value the privacy of our online visitors and registered users ("User" or "You" or "Your"), and we prioritize the security of your personal information. Our commitment lies in safeguarding your Personally Identifiable Information ("PII") collected during your usage of our web or app, as well as when applying for or receiving any of our products or services ("Services").

If you check the option of having read and agree to the user privacy agreement, it will be regarded as your acknowledgement, acceptance of this agreement and agree to be bound by the terms of this agreement.
It is ZemCash’s policy to comply with all applicable privacy and data protection laws. This commitment reflects the value we place on earning and keeping the trust of our customers, business partners and others who share their personal information with us. This Policy applies to all Internet sites and mobile applications operated by or on behalf of ZemCash and includes other entities worldwide affiliated with ZemCash. It also applies to personal information ZemCash may otherwise collect: (i) through our products and services; (ii) when you interact with us by means other than a ZemCash Internet Site or App, i.e. in person, by telephone, or via other means of telecommunications; and (iii) from our employees, collectors, third party investigators, and other business partners (collectively “Business Partners”).
The information obtained by ZemCash will only be used for ZemCash business needs relating to loans made by consumers / users of this application service, including but not limited to feasibility analysis of loan products, the need to process transactions, carry out court orders, applicable legal processes and process reports to the competent authorities.
1. ZemCash Privacy Policy
ZemCash is a mobile application software (“App”) available on the Google Play Store (“App”) which you have downloaded onto your mobile phone, cellphone or handheld device (Device).
To the extent required by applicable law, whenever ZemCash collects personal information, ZemCash will:
i. provide timely and appropriate notice to you about our data practices;
ii. collect your personal information only for specified purposes. The information we collect will be relevant, adequate and not excessive for the purposes for which it is collected;
iii. process your personal information in a manner consistent with the purposes for which it was originally collected or to which you have subsequently consented;
iv. take commercially reasonable steps to ensure that your personal information is reliable for its intended use, accurate, complete, and, where necessary, kept up-to-date;
not use your personal information for direct marketing purposes without giving you an opportunity to “opt-out”;
v. take appropriate measures, by contract or otherwise, to provide adequate protection for personal information that is disclosed to a third party or transferred to another country, including transfers within ZemCash.
This Policy constitutes as an inseparable part of ZemCash Credit Agreement.

ZemCash collects personal information you provide us, which may include: (i) contact information, such as your name, company name, job title, address, e-mail address, and phone number; (ii) additional information about you to help us get to know you better, such as your gender, age, date of birth, nationality, information about how you use our products, and demographic information; (iii) comments, questions, requests and orders you may make; (iv) financial information needed to process loans and payments, such as credit card or account information or other banking information; (v) log-in information, including, if applicable, social media account information for login purposes, if applicable; (vi) information about your preferences, such as your preferred methods of communication and product types in which you are interested (vii) phone contacts in your device needed for risk management and control, anti-fraud monitoring, debt collection purposes, if in case the information provided in the credit agreement is false, invalid or otherwise not responsive to our collection attempts.
It is understood that when you have submitted your information to ZemCash, you expressly guarantee the correctness of the data provided and expressly consent to the collection and processing of such information for whichever purpose it may serve under the agreement.
Information Automatically Gathered from Your Device
Ads Tracking
Permits the application to utilize your IDFA (Identifier for Advertisers) information to monitor and optimize your product experience throughout the loan application process, ultimately enhancing your loan experience.
Location
Authorizes the application to access your current location information to validate if your loan application falls within our service area.
Calendar
Allows the application to generate and manage repayment schedules, ensuring you stay on track with your payments and avoid any missed payments.
We will upload encrypted information to the server,the server address is https://api.zemektlimited.com. We will not trade this information to third parties. However, in order to provide you with services, we may share your information with trusted third parties for payment, identity verification and other services. If you do not agree to the above authorization, we will not be able to assess your credit, please exit the application.
3. ZemCash’s Usage of Personal Information
ZemCash may use your personal information to:
Develop and manage our relationships with you and our Business Partners. This may include: (i) delivering services or carrying out transactions that you or our Business Partners have requested; (ii) providing information about ZemCash products, services, and transactions, and advertisements, that may be of interest to you; (iii) providing you and our Business Partners a more consistent experience in interacting with ZemCash, including by learning more about you and how you use and interact with ZemCash Internet Sites, Apps, products, and services; and (iv) planning, managing, and performing under our contractual relationships with our Business Partners.
Communicate with you. This may include: (i) informing you of ZemCash products, services, and promotional activities that may be of interest to you; (ii) providing information about relevant ZemCash products, services, and transactions, including, for example, pricing, information about product or service improvements; (iii) responding to questions or inquiries that you make, including customer service requests; and (iv) inviting you to participate in, or informing you of the results of, customer satisfaction or market research surveys.
Provide and improve our Internet Sites, Apps, products, and services. This may include: (i) customizing them to your preferences or interests, making them more compatible with your technology, or otherwise making them easier to use; (ii) maintaining the security of and otherwise protecting them; and (iii) and developing new ZemCash Internet Sites, Apps, products and services.

ZemCash may share your personal information with third parties we hire to perform support services for us such as but not limited to collection services, background investigation, and skip tracing among others. These third parties are required to use the personal information we share with them only to perform services on our behalf and to treat your personal information in compliance with all applicable privacy and data protection laws.
In some cases, ZemCash may share your personal information with third parties who partner with us to provide products and services to our customers. If so, we will require our Business Partners to use that information in a manner consistent with this Policy, any applicable Specific Privacy Statements, and all applicable privacy and data protection laws.

ZemCash may share your personal information with third parties in connection with the sale, purchase, merger, reorganization, liquidation or dissolution of ZemCash or a ZemCash business unit, or under similar circumstances. If such an event occurs, we will take appropriate steps to protect your personal information.
Kindly note, by click in the Checkbox, you permit （your institution）to share your credit information, both positive and negative, with Credit Bureaus, and also to check your credit report for credit appraisal purposes.
ZemCash may share your information with your permission or at your request.
ZemCash may share anonymized or aggregated information internally and with third parties for any purpose. Such information will not identify you individually.
5. Retain of the Data
We will delete your date, if we refuse to provide service to you further. We retain your information for as long as your account is active or as needed to provide our services to you, comply with our legal and statutory obligations or verify your information with a financial institution.
We are statutorily obligated to retain the data you provide us with in order to process transactions, ensure settlements, make refunds, identify fraud and in compliance with laws and regulatory guidelines applicable to us, our banking providers and card processors.
Therefore, even after closing your ZemCash account, we will retain certain Personal Information and transaction data to comply with these obligations. All Personal Information shall be destroyed by us where possible. For all Personal Data and records obtained, used and stored by us, we shall perform periodical reviews of the data retained to confirm the accuracy, purpose, validity and requirement to retain.
The length of storage of Personal Informaiton shall, amongst other things, be determined by:
a.the contract terms agreed between you and us or as long as it is needed for the purpose for which it was obtained; or
b.whether the transaction or relationship has statutory implication or a required retention period; or
c.whether there is an express request for deletion of Personal Data by the Data Subject, provided that such request will only be treated where the Data Subject is not under any investigation which may require us to retain such Personal Data or there is no subsisting contractual arrangement with the Data Subject that would require the processing of the Personal Data; or
d.whether we have another lawful basis for retaining that information beyond the period for which it is necessary to serve the original purpose.

Your personal information will generally be stored in ZemCash databases maintained by our service providers. Many of these databases are stored on servers located in the Nigeria.
ZemCash takes appropriate measures, by contract or otherwise, to provide adequate protection for personal information that is disclosed to a third party or transferred to another country, including transfers within ZemCash.
ZemCash maintains reasonable safeguards to protect the confidentiality, security and integrity of your personal information. Although we use security measures to help protect your personal information against unauthorized disclosure, misuse, or alteration, as is the case with all computer networks linked to the Internet, we cannot guarantee the security of information provided over the Internet and will not be responsible for breaches of security beyond our reasonable control.
ZemCash shall not be held accountable or legally liable for any data breach, misuse, disclosure, loss or unlawful sharing due to the fault of its users’ failure to protect and secure their username and password or some other form of negligence.
7. Age Restriction
Our website and services are not directed to children under 18. We do not knowingly collect information from children under 18. If as a parent or guardian, you become aware that your child or ward child has provided us with any information without your consent, please contact us through the details provided in this Privacy Policy.
8. Revision of Privacy Policy
This agreement can be updated by ZemCash online at any time. Once the updated agreement terms are announced, they will replace the original agreement terms without prior notice. Users can check the latest version of the agreement terms in this APP. Any modification will only apply to the personal information we may collect and the personal information we will collect after publishing. After modifying the terms of the agreement, if the user does not accept the modified terms, please stop using the service provided by this APP immediately, and the user's continued use of the service will be deemed to be an acceptance of the modified agreement.
